Seriously Candidate Privacy Policy

Purpose and Scope

Seriously, including its subsidiaries and affiliates (collectively, “Seriously”, “we”, “us”) are committed to protecting and respecting your privacy. This privacy statement describes the handling of personal data obtained about the internal and external job applicants, who have applied directly through Seriously online recruitment system as well as through third party career websites (collectively, “Application Sites”). It also describes the handling of personal data of any prospective candidates, such as those individuals who expressed an interest in receiving news and details about future Seriously opportunities.

Where you apply for a job opening posted by us, this Privacy Supplement will apply to our processing of your personal data in addition to our general Privacy Policy which has been provided to you separately or is available on our intranet Website.

Where you apply for a job opening via the application function on a job site or similar online service provider (“Partner”), you should note that the relevant Partner may retain your personal data and may also collect data from us in respect of the progress of your application. Any use by the Partner of your data will be in accordance with the Partner’s Privacy Policy.

Types Of Personal Data We Collect

We collect and process some or all of the following types of information from you, when you apply directly through an online job site, via email, in person at interviews and/or by any other method:

  • Your name, address, email address, telephone number and other contact information;
  • Date of birth;
  • Educational information, qualifications, experience, information relating to your employment history, skills and other experience that you provide to us;
  • Notes and other information generated by interviewers and recruiters based on your application or their interactions with you;
  • Details of how you heard about the position you are applying for;
  • Any sensitive and/or demographic information provided by you during the application or recruitment process such as gender, information about your citizenship and/or nationality and immigration status, medical or health information and/or your racial or ethnic origin
  • Results and other information related to tests or assignments you may complete as part of the recruitment process, and other information we need to make an employment offer to you and to perform other related tasks to facilitate your employment with us (including to offer relocation services to you and your family, current and/or desired salary and other terms relating to compensation and benefits packages).

We may also receive your personal data from a third party who recommends you as a candidate for a specific job opening or for our business more generally.’

We may keep a record of your progress through any hiring process that we may conduct. If you contact Us, we may also keep a record of that correspondence.

Using Your Personal Data

We rely on legitimate interest as the lawful basis on which We collect and use your personal data. Our legitimate interests are the recruitment of staff for our business. We may also use your personal data to comply with our contractual obligations to you or to take steps to enter into a contract with you, or to comply with our legal obligations.

Where you apply for a job opening through third party platforms, we rely on your consent, which is freely given by you during the application process, to disclose your personal data on the basis described below.

We use information held about you in the following ways:

  • To assess and evaluate your skills, qualifications and interests against the position applied for and/or other positions;
  • To verify your information, including through reference checks and, where applicable, background checks;
  • To communicate with you in respect of the recruitment process;
  • To assist you with obtaining an immigration visa or work permit where and if required;
  • To manage workplace safety and health;
  • To send you, with your consent, information about positions within Seriously which may be of interest to you;
  • To perform administrative functions (including record-keeping, internal reporting, and handling payments);
  • To analyze and develop our recruitment processes and ability to attract talent;
  • To detect, prevent and respond to fraud or potentially illegal activities;
  • To comply with legal obligations to which we are subject and cooperate with regulators and law enforcement bodies;
  • to protect the rights and property of Seriously, our users, applicants, candidates, employees or the public as required or permitted by law.

If you are offered and accept employment with Seriously, the information collected during the application and recruitment process will become part of your employment record.

Automated Decision Making/Profiling

We do not use your data to make automated decisions which significantly affect you. By an “automated decision”, we mean a decision made by an information system without any human intervention.

Sharing Your Personal Data

While we do not sell or market your personal data, we may share your personal data with third parties in limited situations, including with:

  • Seriously and its Affiliates. We may share your personal data with other companies that fall within the same group, for example for recruitment purposes, human resource management and internal reporting.
  • Service providers and business partners. We may share your personal data with our service providers and business partners that perform business operations for us. For example, we may partner with other companies to host the recruitment system and analyze data to improve performance or engage third parties to audit our systems, products or practices. These partners operate under our instruction. We ensure that any Partner we use takes adequate measures to protect your Personal Data, by signing a data processing agreement with it.
  • Law enforcement and other public authorities. We may share your personal data with these parties if necessary to comply with a legal or regulatory obligation, or otherwise to protect our rights, your rights or the rights of any third party.

Security Of Your Personal Data

We take appropriate measures to prevent your personal data from being accidentally lost, used or accessed in an unauthorized way. We limit access to your personal data to those who have a genuine business need to know it. Those processing your information will do so only in an authorized manner and are subject to a duty of confidentiality.

We also request our affiliates to implement such measures in order to secure the information we provide them. However, although efforts are made to secure personal data, we cannot guarantee its absolute protection.

International Data Transfers

We store your personal data about candidates and applicants on a third-party recruitment system located in the United States, subject to the Privacy Shield framework.

Your personal data may also be sent outside of the European Union, for example, to Israel, Hong Kong and other countries. When we transfer, store, and use personal data collected in the EEA outside of the EEA, we comply with our legal obligations and ensure that your personal data is subject to suitable safeguards (such as encrypting communication) or transferred to “approved” territories. If we share with entities which are not subject to the Privacy Shield framework, we make sure that these entities ensure an adequate level of protection, the transfer is supported by the European Commission’s standard contractual clauses for the transfer of personal data to a country outside the European Countries.

Retention Of Your Personal Data

We will keep your data for as long as necessary to achieve the purpose(s) for which it was collected, including compliance with any legal, accounting, or reporting requirements.

Generally, where you were considered but not selected for an open position, we will retain your applicant data for 2 years from the date you were informed of the decision. If you sent an open application which is not directed to a specific open position, we keep those applications for 12 months.

We retain this information for various reasons, including in case we face a legal challenge in respect of a recruitment decision, to consider you for other current or future jobs at Seriously and to help us better understand, analyze and improve our recruitment processes. If you have indicated that you wish to hear about or be considered for other open positions, we may keep your data as long as you inform us otherwise. If you are selected for a position, we will transfer some or all of your data to our employee records and retain it according to the policies we apply to those records.

Your Data Protection Rights

You have the following data protection rights:

  • Right of access. You have a right to know what personal data we hold about you or to receive a confirmation that we do not process data concerning you.
  • Right to rectification. You have a right to have incomplete or incorrect personal data rectified. This means that if there are errors in the data concerning you, or if it is inaccurate or deficient, you have the right to ask Seriously to rectify or complete that data.
  • Right to erasure (‘Right to be forgotten’). You have the right to have your personal data erased in certain situations, for example, when the processing of your data is no longer necessary for the purposes for which it was collected. Please note that the data can be necessary to perform the contract between you and Seriously, or Seriously can have compelling legitimate grounds to retain certain data.
  • Right to object. When the processing of your personal data is based on legitimate interest, you have a right to object to such processing on grounds relating to your particular situation. You have always a right to object to direct marketing.
  • Right to restriction of processing. In certain situations, you might have a right to restrict the processing of your personal data. When the processing has been restricted, your data will only be stored and not processed further. For example, if you contest the accuracy of your data, you have the right to have the contested data under a restriction of processing during the time when it is ensured that the data is accurate.
  • Right to data portability. When the processing of your personal data is based on a contract or consent and carried out by automated means, you have a right to obtain the data you have provided to Seriously in a machine-readable format so that you can transfer it to another controller.

If you believe that Seriously infringed upon your rights according to applicable data protection law, you have a right to lodge a complaint with the data protection authority, in the Member State of your residence, place of work or of an alleged infringement of the GDPR.
